Terms and Conditions

These are the terms you agree to when you order a personalised song from me. I have tried to write them in plain English rather than legalese. If anything is unclear, email me at info@nathangrisdale.co.uk before you order and I will explain it.

1. Who you are dealing with

I am Nathan Grisdale, a singer-songwriter based in the United Kingdom, trading as Nathan Grisdale Music. You can reach me at info@nathangrisdale.co.uk, and I will give you my full trading address on request. There is no call centre and no support desk. Emails come to me.

2. What you are buying

An original song, written and recorded specifically for you, based on the details you give me. Songs are usually between three and four minutes long.

It is delivered as an audio file you download. Nothing is posted to you, and you do not receive sheet music or separate recorded parts unless we have agreed that separately.

Every song is made to your own specification. That has a legal consequence for cancelling, which I explain in section 7.

3. Placing your order

When you order you fill in a brief: who the song is for, the occasion, the mood or feeling you are after, four memories or events you would like included, and the story behind it.

The brief is genuinely what I work from. I can only write about what you tell me, so the more detail you give me, the more personal the song will be.

Your order is accepted once your payment clears and you receive a confirmation email with an order reference. Please quote that reference in any correspondence.

4. Prices and payment

Prices are shown at checkout in pounds sterling and are confirmed in your order email. Different packages have different prices and turnaround times.

You can pay by credit or debit card, or through PayPal. Card and PayPal details go straight to the payment provider and never pass through my website.

The price you see at checkout is the price you pay. There is nothing added on afterwards, and VAT is included where it applies.

5. How long it takes

Each package states its own turnaround on the pricing page, and that is the one that applies to your order — it is shown to you before you pay and repeated in your confirmation email.

The clock starts when your payment clears and I have a brief I can work from. If something important is missing I will email you, and the turnaround starts from the point I have what I need.

If I am going to miss your date, I will tell you rather than go quiet. If you have a hard deadline — a wedding, a funeral, a birthday — please say so in your order notes, and get in touch before ordering if it is tight.

6. Delivery

When your song is ready I will email you a private download link. The link stays active for 30 days, so please save the file to your own device rather than relying on the link.

If your link has expired or stopped working, email me and I will issue a new one. There is no charge for that.

If the email has not arrived when you expected it, check your spam folder first, then email me.

7. Cancelling, and refunds

Because each song is written specifically to your specification, the usual 14-day right to change your mind under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 does not apply once I have started work. That is how the law treats bespoke goods, rather than me being awkward about it.

In practice, here is what I will do:

  • Before I have started writing — tell me and I will refund you in full.
  • After I have started but before delivery — I will refund a fair proportion, based on how much of the work is already done.
  • After delivery — no refund, because you have the song. If there is something wrong with it, section 12 covers that.

8. Changes and revisions

One round of revisions is included with every song. Tell me what is not right and I will put it right.

Corrections are always fine and do not count against that: a misspelled name, a wrong date, a detail I have misheard or misunderstood. Just tell me.

Deciding you want a different song from the one you briefed is a new commission rather than a revision, and I will quote for it separately.

9. Who owns the song, and how you can use it

I keep the copyright in the music, the lyrics and the recording. You get a permanent, worldwide licence to use the song for personal, non-commercial purposes.

That means you can:

  • play it at the wedding, party, funeral or occasion it was written for;
  • share it privately with family and friends;
  • post it on your own personal social media accounts.

It does not cover:

  • selling the song, or charging anyone for access to it;
  • uploading it to Spotify, Apple Music or any other streaming or download service;
  • using it in advertising, or in any business or commercial setting;
  • broadcasting it on radio, television or in a film or programme.

If you want any of those things, email me. It is usually possible — it is just a separate conversation and a separate agreement.

10. Using your song in my own work

I will not put your song, your name or your story on my website, my social media or anywhere else public without asking you first. If I would like to, I will email and ask, and you are free to say no. Saying no changes nothing about your order.

11. Briefs I will turn down

I will not write a song that is abusive, harassing, discriminatory, defamatory about a real person, or clearly intended to humiliate or upset someone. If I turn down your brief for that reason I will refund you in full.

12. If something goes wrong

Email me. Most problems turn out to be a detail I have got wrong or a download link that will not open, and both are quick to sort out.

Your rights under the Consumer Rights Act 2015 apply regardless of anything in these terms. If the song is not as described, or has not been made with reasonable care and skill, you are entitled to have it put right or to a reduction in price.

13. Things outside my control

I am one person. Illness, a bereavement, equipment failure or a power cut can delay things. If something like that stops me delivering on time I will tell you as soon as I know, and we will either agree a new date or I will refund you.

14. Limits on my liability

Nothing in these terms limits my liability for death or personal injury caused by negligence, for fraud, or for anything else the law does not allow me to limit.

Otherwise, my liability to you is limited to the amount you paid for your order. I am not liable for indirect or consequential losses — for example, if a song arrives late for an event, I am not liable for the costs of the event itself.

15. Changes to these terms

The terms that apply to your order are the ones published on this page at the time you ordered. If I change them, the changes are not retrospective.

16. Which law applies

These terms are governed by the law of England and Wales, and disputes can be brought in the courts of England and Wales. If you live in Scotland or Northern Ireland, you can also bring proceedings in your own country.
